Diduga Kadis Kominfo Lebong Cemarkan Nama Baik Media, Praktisi Pers Sebut Perbuatan Pidana

Bengkulu, Sentralnews.com- Ulah Doni Swabuana, PLT Kadis Kominfo SP Kabupaten Lebong dapat masuk katagori perbuatan pidana. Selain menyebarkan kabar bohong, tindakan itu mencemarkan nama baik media online RMOLBengkulu.

Menurut praktisi pers Benny Hakim Benardie, delik aduan itu sudah terjadi, saat tangkapan layar atau screen capture berita, yang diberikan label “hoax” dalam ukuran besar, itu diunggah pada akun Facebook, pada hari Selasa, 24 Maret 2020 lalu.

“Memang bijaknya, bila memang redaksi yang dituliskan RMOL Bengkulu keliru, seharusnya Donni Swabuana meminta hak koreksi. Melakukan hak jawab bila statement yang ada dalam berita memang perlu diklarifikasi”, ungkap praktisi pers Benny di kediamannya, Jumat (27/03).

Tapi kini semua sudah terlambat. Perbuatan pidana sudah terjadi. Kini tinggal pihak media yang bersangkutan saja yang punya inisiatif, bila ula itu dirasakan merugikan. Berdamai dengan meminta maaf ujarnya, itu lebih baik dilakukan Donni, dari pada delik ini dilaporkan ke pihak kepolisian.

Tudingan RMOLBengkulu melakukan kabar bohong atau hoaks, sementara aturan UU No 40 Tahun 1999 tentang Pers mengikat atas lembaganya, saya menilik, UU No 1 Tahun 1946 tentang Peraturan Hukum Pidana, pasal 14 dan 15 yang ancaman pidananya hingga 10 tahun penjara. Ini hanya karena menyiarkan tudingan kalau media itu melakukan hoaks tanpa ,menghormasti aturan yang tertera dalam ketentuan UU tentang pers.

“Belum lagi bila pihak penyidik akan menambahkan UU ITE No 19 Tahun 2016 sebagaimana diubah UU No 11 Tahun 2018 untuk menjeratnya, kan bisa berabe”.

Bila label hoaks itu ternyata menimbulkan pencemaran nama baik bagi Media online RMOLBengkulu, maka itulah yang dimaksud pencemaran nama baik dan fitnah sesuai pasal 27 ayat 3 UU ITE. Bila menambikan pasal 310-311 KUHP.

“Saya sebagai praktisi pers hanya menghimbau, sebaiknya kasus ini tidak berlanjut keranah hukum. Baiknya diselesaikan secara adat saja. Donni segera meminta maaf dibeberapa media online dan damai. Damai itu indah”, ungkap Benny. (Ren)
